Terms of Service

1. Acceptance

By accessing or playing Rogue's Cog ("the Game"), you agree to these Terms of Service. If you do not agree, do not use the Game.

2. Age Requirements

• You must be 13 years or older to play the Game (16+ in the EU).
• You must be 18 years or older to make purchases, or have verifiable parental or guardian permission.

3. Free Play Allowance

The Game provides a limited number of free plays per day, as follows:

• Day 1: 5 free plays.
• Days 2–7: 3 free plays per day.
• Day 8 onwards: 2 free plays per day.

This schedule is disclosed in accordance with UK Competition and Markets Authority (CMA) guidance on transparency in free-to-play games. Additional plays may be obtained through credit purchases or a subscription.

4. Payments & Credits

• Credits are purchased via Stripe. All prices are displayed inclusive of applicable taxes.
• Non-refundable after use: Once credits are spent in-game, they cannot be refunded.
• 14-day withdrawal right: Under the EU Consumer Rights Directive, you have 14 days to withdraw from a digital content purchase. By starting gameplay with purchased credits, you expressly consent to waive this withdrawal right, and acknowledge that the digital content has been fully provided.

5. Subscription

• The subscription costs $5.00/month and provides unlimited plays plus subscriber benefits.
• Subscriptions auto-renew monthly until cancelled.
• You may cancel at any time via Settings (accessible within 2 clicks from any screen). Cancellation takes effect at the end of the current billing period.
• Price changes will be communicated with at least 30 days' notice before taking effect. Continued use after a price change constitutes acceptance.

6. Leaderboard Conduct

You agree not to:

• Cheat, exploit bugs, or use any form of automated play (bots, scripts, macros).
• Manipulate scores or leaderboard rankings by any means.
• Interfere with other players' gameplay experience.

Violation may result in score removal, account suspension, or permanent ban at our sole discretion.

7. Accounts

• Accounts are anonymous by default, identified only by a randomly generated UUID.
• Providing an email address is optional and enables account recovery and notifications.
• You may delete your account at any time via Settings or by emailing privacy@roguescog.com.

8. Dispute Resolution & Arbitration

Any disputes arising from these Terms or the Game shall be resolved through binding arbitration administered under the rules of the American Arbitration Association (AAA), except where prohibited by law.

EU/EEA/UK carve-out: If you are a consumer residing in the EU, EEA, or UK, this arbitration clause does not apply to you. You retain the right to bring claims in the courts of your country of residence. You may also use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.

9. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising from your use of or inability to use the Game. Our total liability for any claim shall not exceed the amount you have paid to us in the 12 months preceding the claim. Nothing in these Terms excludes or limits liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

10. Intellectual Property

All content in the Game, including code, artwork, music, and text, is owned by Nestwell Studio, LLC or its licensors and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to play the Game for personal, non-commercial use.

11. Governing Law

These Terms are governed by the laws of [Jurisdiction]. If you are an EU/EEA/UK consumer, mandatory consumer protection laws of your country of residence shall apply to the extent they provide greater protection.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated in-game with at least 30 days' notice. Continued use after changes take effect constitutes acceptance.
